Yesterday the DOT’s Pipeline and Hazardous Materials Safety Administration (PHMSA) published an advanced notice of proposed rulemaking (ANPRM) in the Federal Register (90 FR 23656) on “Hazardous Materials: Mandatory Regulatory Reviews To Unleash American Energy and Improve Government Efficiency”. This rulemaking is intended to solicit stakeholder feedback on whether to repeal or amend any requirements in the Hazardous Materials Rulemaking Procedures and Program Procedures, or the Hazardous Materials Regulations to eliminate undue burdens on the identification, development, and use of domestic energy resources and to improve government efficiency. PHMSA developed this rulemaking in response to four separate Executive Orders signed by President Trump (EO 14154, EO 14156, EO 14192, and EO 14241.
PHMSA is seeking public input about potential regulatory changes in the following areas:
Procedural Regulations
and Actions (8 questions), and
Hazardous Materials Program Procedures and Regulations (26 questions)
Public Comments
PHMSA is soliciting public comments on these questions.
Comments may be submitted via the Federal eRulemaking Portal (www.Regulations.gov; Docket # PHMSA-2025-0032).
Comments should be submitted before August 4th, 2025.
