Review - DHS Publishes Inflation Adjustment Final Rule – 2023

Today, DHS published a final rule in the Federal Register (88 FR 2175-2187) for “Civil Monetary Penalty Adjustments for Inflation”. This is the annual adjustment of civil penalties required by the Federal Civil Penalties Inflation Adjustment Act Improvements Act of 2015 (§701 of PL114-174, 129 STAT 599). This year the inflation adjustment was made using a multiplier of 1.07745.

Effective Date

This final rule is effective today. It will affect penalties assessed after January 13, 2023 whose associated violations occurred after November 2, 2015.
