Yesterday the folks at ISCD added a new Frequently Asked Question to their CFATS Knowledge Center, FAQ #41. With that low number, this was a question and answer that was planned a long time ago, but apparently the question was just asked, allowing it to make the list of questions asked. The question asks: “What is conflict preemption?”
The answer is almost as short; “Conflict preemption simply means that Federal regulations in a given area supersede State or local regulations that conflict with those Federal regulations, or obstruct or frustrate the purpose of Federal objectives.”
Downloadable FAQ List
DHS has updated their downloadable FAQ list to include this ‘new’ FAQ. They also corrected a discrepancy that I noted earlier this week by removing the two remaining outdated FAQs for the Agricultural Survey; FAQ 1690 and 1691.

The numbers of the FAQs are arbitray and they are not sequential.
