Yesterday, the OMB’s Office of Information and Regulatory Affairs (OIRA) announced that it had received an interim final rule from the DOC’s Bureau of Industry and Security (BIS) on “Standards-Related Activities and the Export Administration Regulations”. Earlier versions of the IFR were published on June 18th, 2020 and September 29th, 2022.
According to the Fall 2023 Unified Agenda entry for this rulemaking:
“The Bureau of Industry and Security (BIS) is amending the Export Administration Regulations (EAR) to clarify the applicability of the Export Administration Regulations (EAR) to releases of technology for standards setting or development in standards organizations.”
The BIS additionally notes that: “This regulatory action
will be likely to have international trade and investment effects, or otherwise
be of international interest.”
