Yesterday the OMB’s Office of Information and Regulatory Affairs announced that it had received a final rule from DHS on “Department of Homeland Security Cybersecurity Talent Management System” for review.
According to the Fall 2020 Unified Agenda listing for this rulemaking:
“Under 6 U.S.C. 658 [link added], the Department of Homeland Security "shall prescribe regulations” to implement Department-specific hiring and compensation flexibilities granted in section 658 to recruit and retain persons with the necessary skills to fulfill the Department’s cybersecurity responsibilities. Under this authority, the Department is establishing a new personnel system for cybersecurity personnel, the Department of Homeland Security Cybersecurity Talent Management System (CTMS).”
The quote from §658 comes from §658(b)(6):
“(6) Required regulations
“The Secretary, in coordination
with the Director of the Office of Personnel Management, shall prescribe
regulations for the administration of this section.”
It will be interesting to see how DHS turns that statement
into authority for a direct final rule.
