This afternoon the DHS Infrastructure Security Compliance
Division (ISCD) added a new frequently asked question (FAQ) to the CFATS Knowledge Center. The new
FAQ (# 1770) relates to the relationship between the Chemical-Terrorism
Vulnerability Information (CVI) program and the Freedom of Information Act
(FOIA).
FAQ # 1770 asks: “Can Chemical-terrorism Vulnerability
Information (CVI) be released under the Freedom of Information Act (FOIA)?”
The answer makes clear that CVI protected information may
not be released under either the Federal FOIA nor any similar State or local
laws. It also provides a link to the CVI
Handbook for further clarification of the rules concerning the protection
of CVI.
