PHMSA Sends Gas Distribution Pipeline NPRM to OMB

Yesterday, OMB’s Office of Information and Regulatory Affairs announced that it had received a notice of proposed rulemaking from DOT’s Pipeline and Hazardous Materials Safety Administration (PHMSA) on “Pipeline Safety: Safety of Gas Distribution Pipelines and Other Pipeline Safety Initiatives”. According to the listing for this rulemaking in the Fall 2022 Unified Agenda:

“This rulemaking would amend the pipeline safety regulations to enhance the safety requirements for gas distribution pipelines. The proposed rule is necessary to respond to several mandates from title II of the Protecting our Infrastructure of Pipelines and Enhancing Safety Act of 2020 (PIPES Act of 2020 [Division R of PL 116-260]).”

A PHMSA in-work document notes that this rulemaking would address requirements of Sections 202, 203, 204 and 206 of the 2020 PIPES Act. Those sections address:

§202. Distribution integrity management plans (134 STAT 2237),

§203. Emergency response plans (134 STAT 2239),

§204. Operations and maintenance manuals (134 STAT 2240), and

§206. Pipeline safety practices (134 STAT 2241)
