Ammonium Nitrate ANPRM Published

DHS published in today’s Federal Register the Advanced Notice of Proposed Rule Making (ANPRM) for regulating the sale and transfer of ammonium nitrate. This rule was required by provisions of the Omnibus Budget Bill passed last December. Comments on the ANPRM (docket # DHS 2008-0076) are due by November 29th. The purpose of this proposed rule is to “regulate the sale and transfer of ammonium nitrate by an ammonium nitrate facility * * * to prevent the misappropriation or use of ammonium nitrate in an act of terrorism”. Additionally, DHS has added a new web page describing this same ANPRM. This is similar to the web page I described in yesterday’s blog (see: “RBPS Guidance Web Page”).
