Today CISA published a direct final rule in the Federal Register (86 FR 41889-41894) on “Chemical Facility Anti-Terrorism Standards: Technical Amendments”. The final rule makes non-substantive technical, organizational, and conforming amendments to the Chemical Facility Anti-Terrorism Standards. No notice of proposed rulemaking was necessary for this rulemaking.
The final rule makes changes to the CFATS regulations reflecting the creation of the Cybersecurity and Infrastructure Security Agency as the succeeding agency for the old NPPD that originally oversaw the CFATS program. This involves changes in organizational names and titles of responsible individuals. Additionally, references to the ‘Section 550’ authorization language is being updated to reflect the implementation of 6 USC 621 et seq that was established by the Protecting and Securing Chemical Facilities from Terrorist Attacks Act of 2014 (PL 113-254).
The effective date of the final rule is today.
