Yesterday the OMB’s Office of Information and Regulatory Affairs
(OIRA) announced
that it had received a final rule for review from the Department of Energy
establishing procedures for the issuance of grid security emergency orders. The
Secretary of Energy derives the authority to issue such orders under 18
USC 824o-1(b).
The notice of proposed rulemaking (NPRM) was
published on December 7, 2016.
