Today the US Department of Justice announced
a settlement agreement in a methyl
bromide exposure incident from last year. The press release reports that TERMINIX
International Company and its Virgin Island subsidiary will pay $10 Million in
criminal fines, community service and restitution payments. The company also
agreed to come to a separate medical restitution agreement with the NJ family
that was affected by the incident.
The press release also provides some additional information
about the incident. The unit fumigated was a ground floor unit and the family
occupied an upper floor of the same building. It is almost certain that there
would not have been a reasonable method of sealing the lower level from the
upper level to prevent migration of the methyl bromide into the occupied unit.
