HR 7214 Introduced – Transportation R&D Authorization


Last month Rep Johnson (D,TX) introduced HR 7214, the Surface Transportation Research and Development Act of 2020. The bill would authorize FY 2021 appropriations to the DOT for surface transportation research, development, and deployment. There are two cybersecurity related provisions in the bill.

Highway Safety Improvement Project


Section 102 of the bill would amend 23 USC 148(a)(4)(B) by adding four new categories of to the list of projects that would qualify as Highway Safety Improvement Projects. The last of these new categories is the undefined ‘cybersecurity’.

Autonomous Trucking


Section 207 of the bill would add a new §5507 to 49 USC Chapter 55. It would require DOT to establish the Heavy Freight Autonomous Trucking Research Initiative. In addition to establishing an R&D agenda that would include “analyzing, modeling, and piloting the feasibility and benefits of dedicated autonomous trucking corridors” {new §5507(c)(1)} the initiative would provide deployment guidance. Of the three specific topics to be addressed in the guidance, one would be “cyber-physical security” {new §5507(c)(2)}.

The bill would authorize $6 million per year through 2025 for the initiative.

Moving Forward


Johnson is the Chair of the House Science, Space, and Technology Committee, one of the two committees to which this bill was assigned for consideration. She is also a member of the House Transportation and Infrastructure Committee the other committee. This means that it is highly likely that the SS&T Committee will take up the bill and probable that the T&I Committee will as well.

This is not a must pass authorization bill, but one that will likely make its way to the full House. I suspect that the bill will pass with some bipartisan support. I am not sure that the bill has enough weight to make it to the President’s desk in this COVID-19 impacted election year.

Bills Introduced – 6-15-20


Yesterday with the Senate in Washington and the House meeting in pro forma session there were 56 bills introduced. Two of those bills may receive additional coverage in this blog:

HR 7203 To direct the Secretary of Defense to carry out a pilot program on the implementation of mitigating actions to address vulnerabilities to defense critical electric infrastructure, and for other purposes. Rep. Crow, Jason [D-CO-6]

HR 7214 To authorize appropriations to the Department of Transportation for surface transportation research, development, and deployment, and for other purposes. Rep. Johnson, Eddie Bernice [D-TX-30]

I will be watching HR 7203 for control system security language and HR 7214 for autonomous vehicle security research language.

NOTE: A press report last Friday indicated that Sen. Peters had introduced on that date two pieces of cybersecurity legislation. I commented yesterday on TWITTER that neither bill had been introduced Friday and would probably be introduced today. It obviously did not happen today either, so I went back and did some more checking. The bills were apparently (the bill name that Peters quoted in his press release are not included on the initial introduction description) introduced on Wednesday, S 3928 and S 3929. I reported the introduction of S 3929 but not S 3928 because the description provided made no reference to ‘cybersecurity’, I will now be watching for the publication of that bill as well.

Bills Introduced – 12-03-18


With both the House and Senate in session yesterday, there were 14 bills introduced. I will be watching three of these in the short time left in the 115th Congress:

HR 7213 To amend the Homeland Security Act of 2002 to establish the Countering Weapons of Mass Destruction Office, and for other purposes. Rep. Donovan, Daniel M., Jr. [R-NY-11]

HR 7214 To direct the Secretary of Education to establish a pilot program to award competitive grants for the integration of cybersecurity education, and for other purposes. Rep. Langevin, James R. [D-RI-2]

HJ Res 143 Making further continuing appropriations for fiscal year 2019, and for other purposes. Rep. Frelinghuysen, Rodney P. [R-NJ-11]

HR 7213 is a perennial favorite, but I suspect this version is unique in that it would include CISA language. I am interested in this bill for possible provisions concerning chemical weapons and more importantly the weaponization of industrial chemicals.

HR 7214 looks like an interesting concept from a Congressman noted for his interest in cybersecurity issues. Note: he will be a tad bit more important next year in the Democratic House and this bill will almost certainly reappear then.

HJ Res 143 is a two-week continuing resolution that continues funding those portions of the Government without a passed funding bill (principally DHS and State) until December 21st, 2018. Ostensibly this is required because the House and Senate will be honoring the late President HW Bush today and tomorrow and they will not be able to work on the actual spending bill during that time. This is a relatively ‘clean’ CR as the only added provision is a similar extension of the flood insurance program. This bill will be passed in the House on Thursday and either Thursday or Friday in the Senate.

NOTE: Only HJ Res 143 will see any action in this session; the other two are ‘look what I have done’ bills.
