OMB Approves DOJ cUAS IFR for SLTT LE Agencies

Yesterday, the OMB’s Office of Information and Regulatory Affairs (OIRA) announced that it had approved an interim final rule from the FBI on “Counter-UAS Authority for State, Local, Tribal, and Territorial Law Enforcement and Correctional Agencies. The IFR was submitted to OIRA yesterday. This rulemaking was not listed in the Spring 2025 Unified Agenda. 

Interestingly, yesterday the Public Inspection Issue for the Federal Register reported that a joint rulemaking from DHS and the DOJ/FBI on this issue would be published in the Federal Register on Monday, July 6th, 2026 (which is typically available on Saturday). An ‘unpublished’ version of the IFR is available here. The effective date of that rulemaking is July 1st, 2026. It is based upon authority provided to DHS/DOJ in the SAFER SKYS Act included as TITLE LXXXVI of the FY 2026 National Defense Authorization Act (PL 119-60, 139 STAT. 1938). 

I plan on taking a detailed look at the IFR this weekend.
