TSOB Ratifies 5 TSA Security Directives – 6-26-23

Today, the DHS’ Transportation Security Oversight Board (TSOB) published two ratification notices in the Federal Register (88 FR 36919-36921 and 88 FR 36921-36924) for five Transportation Security Administration security directive issue for pipeline and surface transportation related cybersecurity issues. These are not new actions taken by the TSOB, but rather public notification of ratifications that took place in 2021 and 2022. The following security directives were ratified (links are to ratification discussion),

Security Directive Pipeline–2021–01B on ratified on June 24, 2021,

Security Directive Pipeline–2021–02C on August 19, 2022,

Security Directive 1580–21–01A on November 6^th, 2022,

Security Directive 1582–21–01A on November 6^th, 2022, and

Security Directive 1580/82–2022–01 on November 16, 2022

The TSOB authorized TSA to extend the expiration dates for the last four of the above listed security directives subject to the following conditions:

• There are no changes to the security directives other than an extended expiration date,

• The TSA Administrator makes an affirmative determination that conditions warrant the extension of the directives' requirements, and

• The TSA Administrator documents such a determination and notifies the TSOB.

DHS’s Office of Strategy, Policy, and Plans published a notice in today’s Federal Register (87 FR 31093-31094) announcing that the Transportation Security Oversight Board (TSOB) has ratified Transportation Security Administration (TSA) Security Directive 1580-21-01, Security Directive 1582-21-01, Security Directive Pipeline-2021-01A, and Security Directive Pipeline-2021-02B. This allows these directives to continue in force until the respective published expiration dates.

TSOB Ratifies TSA Pipeline Security Directive #2

Today DHS published a notice in the Federal Register (86 FR 52953) announcing that the Transportation Security Oversight Board (TSOB) has ratified Transportation Security Administration (TSA) Security Directive Pipeline-2021-02. That security directive was issued on July 19^th, 2021.

This review and ratification is required under 49 USC 114(l)(2)(B). That subparagraph only allows an emergency order to last for 90-days unless ratified by the TSOB. According to today’s notice, the TSOB met on August 4^th, 2021 and ratified the Security Directive ‘in its entirety’ on August 17^th, 2021.

The TSOB was established under 49 USC 115. It consists of seven members or their designees

• The Secretary of Homeland Security,

• The Secretary of Transportation,

• The Attorney General,

• The Secretary of Defense,

• The Secretary of the Treasury,

• The Director of National Intelligence, and

• One member appointed by the President to represent the National Security Council.
