BIS Sends IFR to OMB for New International Agreement (PCC) Group

Yesterday, the OMB’s Office of Information and Regulatory Affairs (OIRA) announced that it had received an interim final rule (IFR) from the DOC’s Bureau of Industry and Security (BIS) on “Implementation of Plurilateral Consensus Coalition (PCC) Country Group, Commerce Control List Additions and Revisions, and License Exception PCC”.

There is no entry in the Fall 2023 Unified Agenda for this rulemaking. This makes it difficult to tell anything about the focus or scope of the proposed IFR.

FAR Sends Foreign UAS IFR to OMB

Yesterday, the OMB’s Office of Information and Regulatory Affairs (OIRA) announced that it had received an interim final rule from the Federal Acquisition Regulation on “Federal Acquisition Regulation (FAR); FAR Case 2024-002, Prohibition on Covered Unmanned Aircraft Systems by Covered Foreign Entities”. This rulemaking was not listed in the Fall 2023 Unified Agenda, so there is no specific information on the potential scope of this rulemaking.

This may deal with the requirements of the American Security Drone Act Of 2023 {§1821 of the FY 2024 NDAA (PL 118-31) which prohibits using a GSA SmartPay purchase card to buy any covered unmanned aircraft systems from covered foreign entities.

BIS Sends EAR Interim Final Rule to OMB

Yesterday, the OMB’s Office of Information and Regulatory Affairs (OIRA) announced that it had received an interim final rule (IFR) from DOC’s Bureau of Industry and Security (BIS) on: “Changes to the EAR” (Export Administration Regulations). This rulemaking was not published in the Fall 2023 Unified Agenda. This means that we will have to wait for the IFR to be published in the Federal Register, or see it in the Spring 2024 UA, whichever comes first, to see what these changes are all about. I suspect that they deal with sanctions, but upon whom or what for remains to be seen.
