OMB Approves CG Shale Waste Water ANPRM

On Friday the OMB’s Office of Information and Regulatory Affairs (OIRA) announced that it had approved the Coast Guard’s advance notice of proposed rulemaking (NPRM) for Carriage of Conditionally Permitted Shale Gas Extraction Waste Water in Bulk. This rulemaking was not included in the Fall 2015 Unified Agenda so it is difficult to say exactly will be included.

Shale gas extraction techniques use large amounts of water and produced water (water returned to the surface) is contaminated with crude oil residues. While limited treatment of water on site is done to re-use the water, it ultimately needs to be completely treated at an industrial waste treatment facility before it can be returned to the environment. Barge shipment is sometimes an option for getting the waste water to treatment facilities.


I would expect to see this rulemaking in the Federal Register later this week.
